Terms Of Service

These Terms of Service explain the rules governing your access to and use of PFP Makerly, including its website, AI-powered profile picture tools, generated content, and related services.

  • Effective Date:
  • Last Updated:

Agreement Summary

These Terms describe your responsibilities when using PFP Makerly, the ways the service may be used, how intellectual property is treated, the conditions that apply to payments where paid features are offered, and the basis on which PFP Makerly provides its services.

This summary is provided for convenience only. It is not a substitute for the full Terms below, and the complete Terms govern your use of the service.

01

Acceptance of These Terms

These Terms of Service ("Terms") form a binding agreement between you and PFP Makerly concerning your access to and use of the website at https://pfpmakerly.com and the AI-powered profile picture tools and related services offered through it (together, the "Service").

By accessing or using the Service, creating an account where available, uploading content, or completing a purchase, you confirm that you have read and understood these Terms and, where permitted by applicable law, agree to be bound by them. If you use the Service on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.

If you do not agree with any part of these Terms, you should not access or use the Service. If you have already used the Service, you should stop using it and may contact us at the address in the Contact Information section to ask about closing your account or addressing any outstanding matters. Nothing in this section limits rights you hold under mandatory law.

02

Eligibility

To use the Service you must be old enough to form a legally binding contract under the laws that apply to you, and you must have the legal capacity to accept these Terms. You may not use the Service if you are barred from doing so by applicable law or if your access has previously been terminated for a violation of these Terms.

You must be at least 13 years old to use the Service. PFP Makerly is not directed at children and does not knowingly collect personal information from children under 13, as explained in the Privacy Policy. If you are under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian.

Where a minor is permitted by applicable law to use the Service with the involvement of a parent or legal guardian, that parent or guardian must review and accept these Terms on the minor's behalf and is responsible for the minor's use of the Service. Parents and guardians are encouraged to supervise any upload of photographs of children.

If you believe a minor has used the Service in a way that does not comply with this section, please contact us so that we can review the matter.

03

About PFP Makerly

PFP Makerly is an AI-powered profile picture creation and editing service available online at https://pfpmakerly.com. It is operated as a web-based software service that helps people create and refine profile images for personal, social, and professional use.

The Service is operated by the owner of the website at pfpmakerly.com under the brand name PFP Makerly. If you need to know the legal entity responsible for the Service, for example to send a formal notice or exercise a legal right, please ask through support@pfpmakerly.com and we will provide the information we are required to disclose.

In these Terms, "PFP Makerly", "we", "us", and "our" refer to the operator of the Service identified above. "You" and "your" refer to the person or organization using the Service.

04

Accounts and Access

Some parts of the Service may be used without an account, while others may require you to register or sign in. The provisions in this section apply only to the extent that account features are offered on the website.

  • Accurate information. You agree to provide accurate and current information when creating an account and to keep it up to date.
  • Account security. You are responsible for keeping your login credentials confidential and for taking reasonable steps to prevent unauthorized use of your account.
  • Account activity. You are responsible for activity that occurs under your account, including uploads, generations, downloads, and purchases, unless the activity results from our failure to apply reasonable security.
  • Unauthorized access. Please notify us promptly at support@pfpmakerly.com if you suspect that your account has been accessed without permission.
  • No transfers. You may not sell, share, or transfer your account to another person without our written consent.

We may restrict or suspend an account in the circumstances described in the Suspension and Termination section.

05

Description of Services

PFP Makerly is designed to provide tools in the following categories:

  • AI-powered profile picture generation.
  • Profile picture editing and customization.
  • Creative and professional profile imagery.
  • Background replacement and image enhancement capabilities, where available.
  • Digital image downloads in PNG, JPG, and WebP formats, sized for supported platforms, where supported.

The website describes an online studio that includes tools for cropping and positioning, background styles, borders and frames, shadows, image filters, text overlays and badges, style presets, and platform size presets, alongside AI portrait generation and style options. Which of these tools you can use may depend on your plan.

The features, styles, export formats, resolution options, usage limits, and availability you can access depend on the tools actually offered through the website at any given time. Descriptions on the website or in these Terms are not a promise that a particular feature exists, will remain available, or will be added in the future.

06

AI Image Generation and Processing

When you use the AI tools, the photographs or other inputs you submit are processed by automated systems to produce or modify profile pictures according to the options you choose.

Processing location and providers: creating and editing pictures takes place on servers, which may be run by PFP Makerly or by the AI and image-processing providers we use, and not only on your device. Those providers may receive your uploaded photos and operate under their own terms and privacy policies. Details of how your data is handled are set out in the Privacy Policy.

  • Input requirements. The tool accepts PNG, JPG, and WebP images, which you can upload, drag and drop, or paste from your clipboard, and inputs must meet any size and quality requirements shown in the tool. A clear, well-lit, front-facing photo of a single subject generally gives better results, but we cannot guarantee any particular outcome.
  • Automated processing. Results are produced automatically and are not individually reviewed by a person before delivery.
  • Variation in results. Generating from the same input more than once may produce different results.
  • Errors and failed generations. A generation may fail or return an unusable result because of an input problem, a technical fault, or a provider limitation. Where the Service uses credits or generation allowances, how failed generations are treated follows the rules shown in the tool at the point of use. If a generation fails and you believe you were wrongly charged or debited, contact support and we will review it.
  • Technical and provider limitations. Processing speed, supported formats, and output quality may be affected by device capabilities, network conditions, and the capacity or rules of underlying technology providers.
  • Limits. Generation and download limits that apply to your use will be those shown on the website or in your account.
07

User-Submitted Photos and Content

You may only upload or submit photographs and other content that you own or that you have sufficient permission to use and process. If your content shows another person, you are responsible for having that person's consent where the law or reasonable expectations require it.

You must not submit content that violates anyone's privacy, publicity, copyright, trademark, or other legal rights, or content that is unlawful or prohibited by the Acceptable Use Policy.

Your rights in your content

As between you and PFP Makerly, you retain whatever rights you hold in your original photographs and content, subject to applicable law and the limited permission described below. These Terms do not transfer ownership of your original content to us.

Limited permission we need

You grant PFP Makerly a limited, non-exclusive, revocable permission to receive, store for the period necessary, process, and transmit your submitted files, and to pass them to the service providers involved in processing, solely for the purposes of operating the Service, generating and delivering the results you request, maintaining security, preventing abuse, and complying with law. We do not claim a broader licence over your photographs through these Terms.

The website states that your uploaded photos are private, are used only to create your results, and can be deleted from your account at any time. Uploaded photos and generated images may be stored temporarily so the tool can work and you can download your results, and they are kept only as long as needed for that purpose unless the law requires longer. You can also ask us to delete stored images by emailing support@pfpmakerly.com. Whether an external provider uses submitted content to improve its own models depends on that provider's terms and privacy policy. Further details are described in the Privacy Policy.

08

User Rights and Responsibilities

You may use the Service in accordance with these Terms for the purposes it is designed to support. In return, you are responsible for:

  • The content you upload and the instructions or options you submit.
  • All activity that takes place under your account, where accounts are offered.
  • Reviewing, selecting, and deciding how to use the images you download, including whether they are suitable for your intended purpose.
  • Complying with all laws that apply to you and your use of the Service.
  • Following the rules of any third-party platform, employer, school, or organization where you intend to use a generated image, as some may restrict AI-generated or edited profile pictures.
  • Complying with these Terms.
09

Acceptable Use Policy

You agree not to use PFP Makerly to:

  • Conduct or promote illegal activities.
  • Violate another person's privacy or intellectual property rights.
  • Create or distribute non-consensual intimate imagery.
  • Exploit, sexualize, or create prohibited sexual content involving minors. We prohibit this absolutely and may report it to the appropriate authorities.
  • Impersonate another person for fraud, deception, or other unlawful purposes.
  • Harass, threaten, defame, or harm others.
  • Upload malware or attempt to compromise, probe, or disrupt the website or its infrastructure.
  • Bypass usage limits, payment requirements, or security controls.
  • Scrape, reverse engineer, or otherwise abuse the Service, except to the extent such restrictions are not permitted by law or by an applicable open-source or third-party license.

Nothing in this policy prevents lawful, authorized activity, such as good-faith security research conducted with our permission, or conduct that mandatory law entitles you to carry out. If you are unsure whether a use is permitted, please ask us before proceeding.

10

Intellectual Property Rights

The PFP Makerly website and Service, including its name, logo and branding, interface design, source code, graphics, documentation, text, and other service materials, are owned by PFP Makerly or its licensors and are protected by intellectual property laws. Except for the limited right to use the Service as these Terms allow, no rights in those materials are granted to you.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works of the Service materials except as permitted by law or with our written permission.

The website's intellectual property is separate from the photographs you submit and from the images generated for you. Your submitted photographs remain subject to Section 7, and generated images are addressed in Section 11. We do not claim ownership of all AI-generated images and do not promise exclusive rights in them.

If you give us feedback or suggestions about the Service, we may use them to improve the Service without obligation to you, provided that doing so does not disclose your personal information or your uploaded photographs.

11

Ownership and Use of Generated Images

Subject to these Terms and applicable law, you may use the images you generate and download through the Service for your own profile and identity purposes. Paid plans include commercial use, meaning you may use your pictures on business profiles, company websites, and brand accounts. Commercial use rights for images created only with free features are those stated on the website for the relevant feature. If the website does not say that commercial use is included, please upgrade to a paid plan or contact support before using the image commercially.

The rights you actually hold in a generated image may depend on several factors, including:

  • Whether you had the right to submit the original input.
  • The law of the jurisdiction in which you use the image.
  • The terms of any third-party AI providers involved in producing it.
  • Rights that third parties may hold in elements that appear in the result.
  • The licensing terms shown on the website for your plan.

AI-generated content may not qualify for copyright protection in every jurisdiction, and the law in this area is still developing. We do not promise that a generated image is unique, exclusive, copyrightable, or free from conflict with third-party rights.

12

Paid Plans, Pricing, and Payments

Where PFP Makerly offers paid plans, credit packages, or other paid features, the applicable fees, billing currency, usage allowances, and plan entitlements will be displayed to you before you complete a purchase. The prices and plan details shown at checkout are the ones that apply to that transaction. Current plans are listed on the Pricing page. The billing currency is shown at checkout, and any credit packages that are offered are described, with their allowances, before you pay.

  • Taxes. Displayed prices may or may not include applicable taxes, as indicated at checkout. You are responsible for taxes that apply to your purchase where required by law.
  • Payment processing. Payments are handled by a third-party payment processor using the payment methods offered at checkout, and that processor handles your payment details under its own terms and privacy policy. By paying, you confirm that you are authorized to use the chosen payment method.
  • Confirmation. We will confirm a completed transaction through the website or by email where available. Please check your confirmation for accuracy and contact us promptly about any error.
  • Access. We aim to provide the purchased entitlements promptly, but we do not guarantee uninterrupted or error-free access.
13

Subscriptions and Renewals

PFP Makerly offers paid plans that are billed per billing period. The billing intervals available for each plan are shown at checkout. If one-time purchases or credit packs are offered, they are presented as such at checkout.

For recurring plans, the checkout will clearly state the price, billing interval, subscription length, and the date or manner in which it renews before you confirm. Unless you cancel before the renewal date, a subscription renews automatically for the same period at the then-displayed price, and your selected payment method will be charged. You can cancel a subscription from your account settings, and your plan stays active until the end of the billing period you have already paid for.

If a purchase is a one-time payment or credit package, it does not renew automatically, and no recurring charge will be made for it. We will not apply recurring charges to a purchase that was not presented to you as a subscription.

14

Cancellations and Refunds

Cancelling a subscription stops future renewals, and is separate from requesting a refund for a payment that has already been completed. Cancelling a recurring subscription generally keeps your access in place until the end of the period already paid for, unless stated otherwise at checkout.

Cancellation procedure: cancel from your account settings. Your plan stays active until the end of the current billing period.
Refund eligibility and time limit: refunds are assessed according to any refund terms displayed at checkout and the consumer protection laws that apply to you. Please send your request as soon as possible after the charge, so that we can review it while the details are still clear. Refunds are not automatic, and we may decline a request where the law allows, for example where the service was delivered and used as described at purchase.

To request a refund or ask about a charge, contact support@pfpmakerly.com with the email address used for the purchase and the transaction details. We will review requests according to the policy shown at checkout and the consumer protection laws that apply to you.

Nothing in these Terms limits any statutory right of withdrawal, refund, or remedy that applies to you under mandatory consumer law.

15

Free Features and Usage Limits

PFP Makerly offers a free online studio, with certain features and plans available for a fee. Free features, generation quotas, credit limits, download restrictions, and the conditions for upgrading to a paid plan are those displayed on the website at the time you use it. Where a free feature has a quota, a download restriction, or a difference in output quality compared with paid plans, this is shown in the tool or on the Pricing page.

Where free and paid features differ, such as in output resolution, available styles, or number of generations, those differences are shown on the relevant pages or at the point of use. We may adjust free offerings over time, and we do not promise that any free feature will remain available or unlimited.

16

Third-Party Services

The Service may rely on or integrate with services provided by others, such as external AI providers, payment providers, hosting and website infrastructure, email and form tools, and analytics tools. These third parties operate under their own terms and policies, which may apply in addition to these Terms.

Third-party services may have their own availability, processing rules, and contractual requirements, which we do not control. These include website hosting, AI and image-processing providers, email delivery and newsletter services, analytics tools if enabled, a payment processor for paid plans, security and spam-protection tools, and fonts, icons, and code libraries loaded from content delivery networks. We do not list individual providers by name here; the Privacy Policy describes these categories in more detail.

Links to third-party websites are provided for convenience. We are not responsible for the content or practices of those websites, and your use of them is at your own discretion.

17

Privacy and Data Processing

Our Privacy Policy explains how personal information is collected, used, stored, and shared, including information you provide through contact and newsletter forms on the website, and describes the data-processing practices that apply to the Service. It forms part of your overall relationship with PFP Makerly and should be read together with these Terms.

Information about image retention, any use of data to improve or train models, analytics, cookies, and sharing with third-party providers is governed by the Privacy Policy and the Service's actual technical implementation. If there is a conflict between a statement in these Terms and the Privacy Policy about how personal data is handled, the Privacy Policy controls for that subject. The website's contact form and newsletter signup are built with Contact Form 7 on WordPress, and the information you submit through them is handled as described in the Privacy Policy.

18

Service Availability and Changes

We work to keep the Service available, but features may be updated, modified, limited, or discontinued, and the Service may be temporarily unavailable because of maintenance, technical problems, security needs, or changes in third-party dependencies. We do not guarantee any specific level of uptime, and no service-level agreement applies unless we have agreed to one in writing.

Where applicable law or a contract requires advance notice of a material change or discontinuation, we will give reasonable notice, for example through the website or by email. Where a change would reduce paid entitlements you have already purchased, we will handle that in line with applicable law and the terms shown at purchase.

19

AI Output Limitations

AI-generated images may contain inaccuracies, visual artifacts, unexpected alterations to facial features, hands, clothing, or backgrounds, or results that do not fully match your submitted photograph or the style you requested. Resemblance to the subject varies and cannot be guaranteed.

You are responsible for reviewing generated content before you publish it or use it for professional, commercial, or other important purposes. Do not rely on generated images where accurate depiction of a person is required, such as for identification documents or official records, unless the organization requiring them expressly accepts such images.

20

Disclaimers

To the fullest extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, subject to the features and limitations described in these Terms. We do not warrant that the Service will be uninterrupted, error-free, or secure at all times, that every generation will succeed, or that results will meet your particular expectations or requirements.

These disclaimers do not exclude or limit any warranty, guarantee, or right that cannot lawfully be excluded, including mandatory consumer protections that apply where you live.

21

Limitation of Liability

To the extent permitted by applicable law, PFP Makerly and its operators, personnel, and service providers will not be liable for the following categories of loss arising from or related to your use of, or inability to use, the Service:

  • Indirect, incidental, special, consequential, or exemplary damages.
  • Loss of profits, revenue, business opportunity, goodwill, or anticipated savings.
  • Loss or corruption of data or content, except where caused by our failure to meet legal obligations.
  • Losses resulting from your reliance on AI-generated output, third-party services, or events beyond our reasonable control.

These limitations apply only to the extent the law allows, and they do not affect any liability that cannot lawfully be limited.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, for death or personal injury caused by negligence where applicable, or for breach of mandatory consumer protections.

22

Indemnification

To the extent permitted by applicable law, you agree to be responsible for, and to reimburse PFP Makerly for, reasonable losses and costs arising from third-party claims that result from:

  • Content you submitted that is unlawful or that infringes the rights of others.
  • Your violation of these Terms or applicable law.
  • Your misuse of the Service or of images generated through it.

This obligation does not apply to the extent a claim results from our own breach of these Terms, negligence, or misconduct. We will notify you of any claim for which we expect your assistance, and will act reasonably in handling it.

23

Suspension and Termination

We may restrict, suspend, or terminate your access to all or part of the Service where reasonably necessary, including when:

  • You breach these Terms, including the Acceptable Use Policy.
  • We suspect fraud, payment abuse, or misuse of the Service.
  • Your use presents a security risk to the Service or to other users.
  • We are required to do so by law or by a competent authority.

Where practical and lawful, we will tell you why and, where appropriate, give you an opportunity to address the issue. You may also stop using the Service or close your account at any time.

After suspension or termination, you may lose access to your account, any unused credits, active subscriptions, and stored content, to the extent those features exist. Whether unused credits or paid amounts are forfeited or refunded depends on the reason for termination, how the Service actually works, and applicable law. Where we terminate your access because of your breach of these Terms or misuse of the Service, unused credits and the remainder of a plan may be lost, to the extent the law allows. Where access ends for reasons that are not your fault, we will treat unused paid entitlements fairly and in line with applicable law. Provisions that by their nature should continue, such as those on intellectual property, disclaimers, liability, and dispute resolution, remain in effect.

24

Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which the operator of PFP Makerly is established, without regard to conflict-of-law rules, and subject to any mandatory rules of your place of residence that cannot be changed by agreement. Disputes that cannot be resolved informally may be brought before the competent courts of that jurisdiction, subject to any right you have under mandatory law to bring a claim elsewhere.

Before starting any formal proceeding, we encourage you to contact us at support@pfpmakerly.com so we can try to resolve the matter informally and in good faith.

If you are a consumer, you may have the right to bring a claim in the courts of your place of residence and to rely on mandatory consumer protection laws there, regardless of the governing law selected above.

25

Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, our practices, or legal requirements. The revised version will be published on this page, and the "Last Updated" date at the top will show when it was most recently changed.

For material changes, we will give notice in a manner appropriate to the change, such as a notice on the website or an email to registered users, and will ask for renewed consent where the law requires it. Updated Terms apply from their stated effective date, and do not automatically apply retroactively to disputes or transactions that arose before that date, unless the law permits otherwise. Your continued use of the Service after the effective date of an update, where permitted by law, means you accept the revised Terms. If you do not agree, you should stop using the Service.
